These Terms and Conditions ("Terms") govern your access to and use of the website https://enlightenedparenting.com/parenting-webinar and all related products, services, courses, webinars, educational content, membership services, SMS communications, and other offerings (collectively, the "Services") provided by Enlightened Parenting, a brand owned and operated by Big Thompson Publishing, LLC ("Enlightened Parenting", "we", "us", or "our").

By accessing or using our Services, registering for a webinar, enrolling in a course, purchasing a product, subscribing to our membership, or otherwise interacting with us, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not access or use our Services.

3. Eligibility

You must be at least 18 years old (or the legal age of majority in your jurisdiction if higher) to use our Services. By using the Services, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

4. Description of Services

Enlightened Parenting, a brand owned and operated by Big Thompson Publishing, LLC, provides online parenting education through free webinars, digital courses, membership services, downloadable educational resources, customer support, SMS notifications, email communications, and related services designed to help parents build healthier relationships with their children.

5. Account Registration and Security

To access certain parts of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information

• Maintain the security of your login credentials

• Notify us immediately of any unauthorized access or use

• Be responsible for all activity that occurs under your account

You may not share your account credentials. Sharing logins is a material breach of these Terms and may result in immediate termination of your access without refund.

6. Purchases and Payment

All purchases are processed in U.S. dollars (USD) through our payment processor, Stripe. Stripe handles all payment card data in compliance with PCI-DSS standards. We do not store full payment card numbers on our systems.

By submitting payment information, you represent that you are authorized to use the payment method, and you authorize us, through Stripe, to charge the full purchase price to that payment method.

Prices are subject to change. The price in effect at the time of your purchase is the price you will pay. Applicable taxes are added at checkout where required.

7. Refund Policy - 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on the Enlightened Parenting course.

If you are not satisfied with the course for any reason, you may request a full refund within thirty (30) days of your original purchase date by emailing [email protected] with your order details and a brief reason for the request.

• Approved refunds are processed to the original payment method within 5–10 business days of approval.

• After 30 days from purchase, all sales are final and no refunds will be issued.

• We reserve the right to deny refund requests in cases of suspected abuse, including but not limited to repeated purchase-and-refund cycles, content downloading or scraping followed by a refund request, or violations of the License (Section 8).

• Upon refund, your access to the course and all related materials will be terminated.

8. License to Course Content

Subject to your compliance with these Terms and payment in full, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the course content for your own personal, non-commercial use, for the duration of your access.

You may not:

• Share your account credentials or grant access to anyone else

• Reproduce, copy, download (beyond features we expressly provide), or distribute course materials

• Resell, sublicense, or commercially exploit the course or any portion of it

• Use the course or its content to train any machine learning model, AI system, or competing product

• Reverse-engineer, decompile, scrape, or otherwise attempt to derive source materials

• Remove or alter any copyright, trademark, or proprietary notices

Any of the above is a material breach and may result in immediate termination of your access without refund and may give rise to claims for damages.

9. Intellectual Property

All content available through the Services - including but not limited to the Seven Reasons Modules, the Six Pillars framework, course videos, audio, text, graphics, logos, trademarks, course names, and the design of the website — is the property of Big Thompson Publishing, LLC or its licensors, and is protected by United States and international intellectual property laws.

"Enlightened Parenting" and related logos are trademarks of Big Thompson Publishing, LLC. You may not use them without our prior written permission.

10. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law

• Attempt to gain unauthorized access to the Services, other accounts, or our systems

• Upload, transmit, or distribute viruses, malware, or any harmful code

• Harass, threaten, or abuse our staff, instructors, or other users

• Interfere with or disrupt the Services or servers

• Scrape, crawl, or use automated means to access the Services

• Impersonate any person or misrepresent your affiliation

• Resell or redistribute any part of the Services

11. SMS / Text Messaging Terms

This section governs SMS communications between you and Enlightened Parenting.

Program Description

Enlightened Parenting, a brand owned and operated by Big Thompson Publishing, LLC, may send informational SMS messages to users who voluntarily opt in through our Enlightened Parenting webinar registration form.

Messages may include:

• Webinar registration confirmations

• Webinar reminder notifications

Opt-In Method

You consent to receive SMS messages by providing your mobile phone number through our Enlightened Parenting webinar registration form and affirmatively checking the SMS consent checkbox.

SMS consent is collected only through our Enlightened Parenting webinar registration form. We do not purchase, sell, rent, or obtain mobile phone numbers or SMS consent from third parties.

THE SERVICES, INCLUDING ALL COURSE CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The course content is for educational and informational purposes only. It is not medical, psychological, psychiatric, therapeutic, legal, or any other form of professional advice. We are not licensed medical, mental health, or legal professionals, and the course does not establish any professional relationship. Each child and family is unique; results vary, and we make no guarantee that following any framework, principle, or recommendation in the course will produce any specific outcome for your child or family.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BIG THOMPSON PUBLISHING, LLC, ENLIGHTENED PARENTING, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Big Thompson Publishing, LLC, its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Services

• Your violation of these Terms

• Your violation of any applicable law or any third-party right (including intellectual property, privacy, or publicity rights)

• Any content you submit, post, or transmit through the Services

16. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any breach of these Terms - including but not limited to sharing login credentials, distributing course content, or engaging in fraudulent activity. Upon termination, your license to the course content immediately ends, and we may, at our discretion, deny a refund.

Sections that by their nature should survive termination - including License to Course Content, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law - will survive.

17. Dispute Resolution and Binding Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

Binding individual arbitration

You and Big Thompson Publishing, LLC, agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved exclusively through final and binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in English, by a single arbitrator, and may be held in person, by telephone, or online.

Class action waiver

You and we agree that any arbitration or proceeding will be conducted only on an individual basis, not as a class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-day opt-out

You may opt out of this Dispute Resolution section by sending written notice within thirty (30) days of your first purchase to [email protected] with the subject line "Arbitration Opt-Out," including your full name, the email used at purchase, and a clear statement that you wish to opt out. If you opt out, neither party will be bound to arbitrate disputes.

Small claims carve-out

Either party may bring an individual claim in a small claims court of competent jurisdiction, provided the claim qualifies and remains on an individual (non-representative) basis.

Venue for non-arbitrated claims

Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Johnson County, Kansas. You consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Kansas, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

19. Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, acts of war or terrorism, civil disturbances, government actions, labor disputes, power or telecommunications failures, internet outages, or pandemic-related disruptions.

20. Third-Party Services

The Services rely on third-party service providers, including GoHighLevel (course and message delivery), Stripe (payments), and Meta (advertising). Use of these third-party services is also subject to their respective terms and privacy policies. We are not responsible for the acts, omissions, or policies of third parties.

21. Changes to These Terms

We may revise these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated through our website. Your continued use of the Services after a revision constitutes your acceptance of the revised Terms.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Big Thompson Publishing, LLC concerning the Services and supersede all prior agreements, communications, and understandings.

23. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

24. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

25. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
